Olesya Mykhailenko Studied Mediation Aspects in the Area of the Intellectual Property Law

16.06.2015 Olesya Mykhailenko, Associate at Gvozdiy and Oberkovych Law Firm participated in a Round Table Conference named Mediation in the area of the intellectual property law (hereinafter – the IP), which was held on June 11, 2015 by the State Intellectual Property Service of Ukraine together with National Association of Mediators of Ukraine.

Today's court procedure for resolving disputes in the IP law area is not able to meet the requirements of the market, as it is time consuming and expensive. Therefore the event moderators considerated the alternative types of dispute's resolution in the IP law area, in particular, mediation.
Olesya Mykhailenko joined the discussion on the mediation’s relevance in the IP law area, issues of establishing IP rights violations on the Internet and collecting an evidence base in the event of revealing such violations.

In particular, the speakers presented significant aspects of the mediation and mediator functionality and highlighted the practical issues of mediation in the area of intellectual property law. In the framework of the event they also discussed the risks of conflict resolution through the courts, as well as mediation advantages.

Then the participants showed the cases, where the mediation can not be used and outlined the complicated issues of using mediation toward solving conflicts in the IP area on the Internet.

Among the participants of the event were Ph.D. Galyna Yeryomenko, the President of National Association of Mediators of Ukraine, Mr. Igor Starodubov, the Director of the Research Centre for Forensic Expertise on Intellectual Property of the Ministry of Justice of Ukraine, Mr. Oleg Chernobay, the President of AAU as well as leading mediators, lawyers and other professionals and experts.
