Due to the increasing integration of Ukrainian enterprises into international commerce and the globalization of sectors of the economy, the issue of lawful behaviour in the market and development and maintenance of competitive policies are particularly important today. Most foreign and domestic companies in Ukraine are increasingly guided by the requirements of antimonopoly and competition legislation in their work and cooperate with the Antimonopoly Committee of Ukraine (AMCU). Every big contract must be accompanied by an analysis of its compliance with current legislation on competition. In particular, it is necessary to receive a preliminary conclusion and clearance from the AMCU for the creation of industrial and financial groups, joint ventures or strategic alliances, mergers of companies, acquisition of assets or acquisition of control over an enterprise, coordinated actions, etc.

Experts from Gvozdiy & Oberkovych Law Firm base their cooperation with clients, on the issues of antimonopoly and competition legislation, on an understanding of their business specifics and current legal requirements. The result of such cooperation with a client is a clear, targeted and cost-effective range of legal advice and effective solutions. The firm’s lawyers, together with the internal human resources of the client company form effective teams to either form an optimal model of an agreement or determine the best legal position.

Our experts have extensive experience of strategic consulting of foreign and Ukrainian companies at all stages of the procedure for obtaining AMCU clearance for the creation of concentrations, as well as representing the interests of clients in cases on unfair competition. A team of our firm’s lawyers also has practical knowledge of issues regarding fraud and price manipulation on the commodity and financial markets used by competing businesses. In addition, we carry out regular monitoring of our clients activities so as to prevent violations of competition law, and we also monitor the actions of competitors who may be able to pose a threat to their businesses.

We protect the interests of our clients in investigations carried out by the AMCU in cases of abuse of monopolistic position, provide support in proceedings initiated by the AMCU and in litigation of varying complexity associated with anticompetitive acts or the disputing of fines levied unlawfully by antimonopoly authorities. Our expertise also includes advising clients on issues of structuring procurement and commercial operations and the development of strategies to minimize the risks of violating antimonopoly legislation.
