The GOLAW team defended the rights of employees of JSC “Ukrzaliznytsia” in a dispute over health benefits

GOLAW defended the rights of the Professional Union of Railway Workers and Transport Builders of Ukraine, which acts in the interests of all employees of JSC “Ukrzaliznytsia,” in a dispute with JSC “Ukrzaliznytsia” and members of its management board.

The dispute arose in connection with the JSC “Ukrzaliznytsia” board’s unilateral suspension of provisions in the Sectoral Agreement and collective agreements that provided for health benefits for employees. As a result, such payments were suspended and subsequently set at a minimum level different from that guaranteed by the collective agreements. Furthermore, the relevant changes were not agreed upon with the trade union bodies.

The GOLAW team conducted a comprehensive analysis of the decisions of the management of JSC “Ukrzaliznytsia” and proved the illegality of the inaction of JSC “Ukrzaliznytsia” and its management in addressing violations of the Sectoral Agreement and collective agreements. Following the court’s review of the case, the court effectively restored the employees’ right to receive health benefits in the amounts guaranteed by collective agreements.
