GOLAW experts spoke at the national teleconference “Searches in Healthcare Facilities” organized by Expertus

Attorneys at Criminal Law and White Collar Defence practice at GOLAW Kristina Kolchynska and Anastasiia Shapoval participated in the national teleconference “Searches in Healthcare Facilities: What Healthcare Facility Directors Should Do During Inspections and Investigative Actions,” organized by Expertus.

During the presentation, the GOLAW team shared practical experience in defending clients in criminal proceedings related to the implementation of the Medical Guarantees Program and cooperation with the National Health Service of Ukraine (NHSU). The key emphasis was placed on the fact that increased funding for the healthcare sector is accompanied by a systematic rise in criminal proceedings against healthcare facility managers and employees.

The first part of the presentation analyzed typical grounds for initiating criminal proceedings. Special attention was given to the most common cases currently under investigation by law enforcement agencies, including the entry of false information into the Electronic Health Record System (EHRS) (misrepresentation of the type of service provided, fictitious services and patients, etc.) and the receipt of payment for services that should have been provided free of charge. The speakers emphasized that it is precisely the systematic entry of knowingly false data for the purpose of obtaining budget funds that crosses the line, transforming administrative errors into criminal liability.

The second part of the presentation detailed the mechanisms by which law enforcement agencies detect such violations. It was specifically emphasized that a search is usually not the start of a pre-trial investigation, but merely another stage in gathering evidence.

In conclusion, it was emphasized that effective defense in such cases is possible only with a proactive legal strategy.
