BUSINESS BREAKFAST | Scheduled Tax Audits: Common Findings in Audit Reports and How Businesses Should Respond
Scheduled tax audits are always a serious challenge for companies, as they require impeccable documentation and the readiness to defend business decisions with sound reasoning. To help Ukrainian and foreign businesses prepare for visits from tax authorities and minimize potential financial risks, we are organizing a special business breakfast. This event will serve as a practical forum for discussing pressing issues in tax audits, where leading experts will discuss common claims made by tax authorities during such audits, explain what taxpayers should pay attention to, and share strategies for effectively defending against unfounded additional assessments.
The speakers at the event will be:
- Viktoriia Bublichenko — Partner at GOLAW, Head of Tax, Restructuring, Claims and Recoveries practice. Viktoria has many years of experience advising Ukrainian and foreign companies on taxation issues in Ukraine, including under international conventions; she provides legal assistance to businesses in preparing for and undergoing tax audits and successfully challenges audit results through administrative (pre-trial) and judicial proceedings;
- Tetiana Fedorenko — Senior Associate at Tax, Restructuring, Claims and Recoveries practice at GOLAW, specializing in tax consulting, support during tax audits, tax planning, and business defense. She has significant experience successfully challenging decisions by tax authorities and developing effective tax risk management strategies.
At the business breakfast, we will discuss:
- common findings by tax authorities during scheduled audits and how to address them:
- the lack of substance in business transactions;
- non-recognition of expenses related to exchange rate differences;
- failure to discount receivables;
- unjustified use of reduced rates under double taxation treaties;
- reclassification of relationships with sole proprietors;
- failure to use cash registers/electronic cash registers;
- practical advice on protecting business rights after an audit.
