Restructuring, working with non-performing loans (NPLs) and insolvency require not only knowledge of the law but also considerable practical experience. The same financial distress looks different to a creditor, a debtor, an owner or an investor — and it is the strategy chosen, rather than the procedure itself, that determines the final result.
GOLAW lawyers have many years of expertise in representing Ukrainian and international financial institutions, banks and insurance companies — in lending, debt restructuring, support of insolvency proceedings and the resolution of disputes with bad-faith debtors. We provide comprehensive support of insolvency proceedings both at the initiative of debtors and at the request of creditors, working at every stage — from out-of-court debt settlement to reorganisation, liquidation, enforcement of security and the recovery of transferred assets.
Insolvency is not an isolated court case but a complex project in which law, assets, finance, negotiations and litigation work at the same time. Within a single engagement we therefore combine restructuring, insolvency, banking and finance, litigation, corporate and tax expertise, and where needed we bring in appraisers, financial analysts and asset-tracing specialists.
GOLAW’s key strength is the ability to develop effective restructuring strategies and adapt proven legal instruments to each client’s needs. GOLAW successfully represented a Czech state-owned bank as a bankruptcy creditor in the insolvency of a debtor in Ukraine and supported enforcement against a pledged integral property complex; it also advised a foreign holding on the restructuring of distressed obligations.
