Digital IP & NFT Protection

Protection of intellectual property and NFT assets — from DMCA takedowns and brand protection to trademark/copyright registration and response to infringements in web3 and metaverse environments.

Who we assist:

Brand owners and digital content rightsholders (creators, media teams, design studios, developers), IT and web3 companies issuing or using NFTs/digital assets, marketplaces, sellers, and e-commerce businesses facing content/design copying risks, as well as investors in NFT collections.

What is legal support in digital ip & nft protection?

Legal support within Digital IP & NFT Protection is a comprehensive set of legal measures aimed at identifying, properly documenting, and protecting intellectual property rights in the digital environment — including content, brand, design, source code, digital products, and NFT assets.

In practice, this includes: defining protectable subject matter (what exactly is protected — trademark, copyright, industrial design), formalizing rights (registrations, IP assignment agreements, licenses), monitoring infringements, and rapid enforcement (DMCA takedowns, cease-and-desist claims, litigation), as well as strategic protection of brand reputation online.

Disputes in web3 and digital ecosystems have specific features: infringements often occur via marketplaces (OpenSea, Rarible, Magic Eden), hosting providers, social networks, and other platforms — rather than directly between two contractual parties. Therefore, key tools include notice-and-takedown procedures (including DMCA in the U.S. and analogous mechanisms in the EU), platform requests to remove content/NFTs, domain disputes (UDRP for domains), and technical documentation of infringements (blockchain explorers, timestamping, screenshot notarization).

In such matters, the GOLAW team acts as legal coordinator for digital asset protection: determining the legal regime of the asset (trademark/copyright/industrial design/commercial identifiers), developing a registration and contractual strategy (licenses, assignments, NDAs, content terms of use, royalty agreements), preparing and submitting DMCA notices and takedown requests, negotiating with platforms and infringers, coordinating enforcement programs (systematic monitoring + rapid response), and representing clients in court and arbitration disputes.

What we do

  • IP strategy: full asset mapping (trademarks/copyright/design), risk assessment, and protection prioritization
  • DMCA takedowns and notice-and-takedown procedures for marketplaces/hosting providers/social networks
  • Trademark/copyright filings and contractual structures (licenses, assignments, NDAs)
  • Protection against NFT/content copying: evidentiary preservation and platform removal requests
  • Disputes involving domains/usernames/brand abuse, phishing, and impersonation
  • Monitoring and enforcement programs (retainers/annual packages) for systematic protection and rapid response
  • Metaverse protection (virtual worlds): brand presence, trademark enforcement, in-world IP disputes

What project legal support includes

1
1
IP Inventory
Comprehensive IP inventory: identifying protectable assets, setting protection priorities, assessing existing risks, and defining territories/jurisdictions where infringements are most likely or most damaging.
2
2
Registration + Contracts
Preparation and filing of trademark, copyright, and industrial design applications in relevant jurisdictions; drafting contractual framework covering ownership and royalties (license agreements, assignment agreements, work-for-hire contracts, royalty sharing arrangements).
3
3
Rapid Takedown
Rapid response to infringements: preparing and submitting DMCA notices and takedown requests to NFT marketplaces, hosting providers, and social networks; monitoring platform compliance; coordinating response in cases of multiple infringements.
4
4
Enforcement
Escalation as needed: cease-and-desist work with infringers, ADR, litigation or arbitration, evidence preservation (screenshot notarization, blockchain evidence), domain disputes via UDRP/URS procedures.
5
5
Monitoring Program
Deployment of continuous infringement monitoring (automated tools + manual review), development of response plans for different infringement types, and regular reporting on detected incidents and actions taken.
6
6
Brand Protection Strategy
Comprehensive online brand protection strategy: countering phishing and scam campaigns, fighting counterfeits on marketplaces, preventing cybersquatting (defensive domain registrations), and monitoring social networks for brand abuse.
7
7
Web3 & Metaverse IP Advisory
Specialized advisory for web3 projects: legal structuring of NFT issuances, royalty enforcement in secondary markets, protection of brand presence in metaverse environments (Decentraland, The Sandbox), and consultations on IP aspects in DAO governance.

Frequently asked questions

  • Does DMCA work for NFT protection?

Often — yes, especially for content, metadata, and NFT marketplaces subject to U.S. jurisdiction or following U.S. standards. The DMCA (Digital Millennium Copyright Act) is an effective tool for rapid removal of infringing content. However, strategy depends on the specific platform, the structure of rights behind the NFT, and the marketplace’s jurisdiction.

  • Can you “take back” an NFT collection from scammers?

Legally, we can pursue takedowns (removal from marketplaces), freezing of sales, and cessation of IP infringement. The actual “return” of NFTs to your wallet depends on technical and jurisdictional realities: if NFTs are on a decentralized protocol, it may be technically impossible to “take” them back, but we can block resale opportunities on major marketplaces.

  • Do I need a trademark registration if I have “first-mover” status in the community?

Yes. Trademark registration significantly strengthens your position in disputes and takedown procedures. “First use” may matter in certain jurisdictions (e.g., common law trademark rights in the U.S.), but formal registration provides stronger enforcement tools: presumption of rights, faster takedown options, and a stronger position in court.

  • How long does a DMCA takedown take?

It depends on the platform. Most marketplaces and hosting providers are expected to respond within 24–72 hours. However, if the infringer files a counter-notice, the process may extend to 10–14 days, after which litigation may become necessary. Speed also depends on the quality of the notice and the availability of registered rights.

  • What should I do if someone copied my NFT artwork?

The recommended sequence: (1) document the infringement (screenshots, blockchain records, timestamps), (2) collect proof of authorship/priority, (3) prepare and submit a DMCA notice or takedown request to the marketplace where the copy is listed, (4) if needed, escalate to a cease-and-desist claim and/or litigation. We support the full cycle from evidence capture to enforcement.

  • Do I need ongoing infringement monitoring?

For brands and active NFT projects — yes, especially if you have already faced copying or phishing incidents. Systematic monitoring enables early detection and rapid response, reducing losses and reputational risks. We offer retainer-based enforcement programs with regular reporting.
