The Public-private partnership (PPP), new reform regulations, is an important element of the reconstruction of Ukraine after the war

On August 25, 2022, Valentyn Gvozdiy, the Managing Partner of GOLAW, was invited to speak at the annual summer event held by the Associated European Energy Consultants (AEEC) where the experts of energy institutions exchanged their own experiences on the massive impact of Europe’s energy crisis on its economies, the energy sector and its policy and legal frameworks.

During the event,experts discussed how to support the reconstruction of its post-war energy systems, including on aspects related to market design and transparency, the cross-border transmission of electricity and gas, and the synchronization of the power systems of Continental Europe and Ukraine, as well as decarbonization and the reduction of fossil fuel dependency.

Valentyn explained the legal aspects of electricity export.

Ukraine can be a reliable partner for Europe on its way to decarbonization and the reduction of fossil fuel dependency. Increasing the export of electricity from Ukraine to Europe can be beneficial for both sides. Today efforts of both sides should be directed at increasing the volume of such exports. He has also pointed out that Public-private partnership (PPP), new reform regulations which were announced and presented by the National Investment Council under the President of Ukraine, is an important element of the reconstruction of Ukraine after the war.

The reform was developed with the participation of Ukrainian and foreign experts, scientists, and business representatives. The corresponding legal act has already been registered in the Parliament – Draft Law on Amendments to Certain Legislative Acts of Ukraine on Improving the Mechanism for Attracting Private Investments Using the Public-Private Partnership Mechanism to Accelerate the Restoration of War-Destroyed Objects and the Construction of New Objects Associated with the Post-War Reconstruction of Ukraine’s Economy

The proposed draft law solves several problems of the implementation of public-private partnership projects at once, namely – simplification of procedures, and consolidation of financial guarantees in legislation, which in turn will provide an opportunity not only to restore the infrastructure destroyed by the war in a short time but also to give impetus to the economy of Ukraine through the launch of production and the creation of new jobs, as well as to develop mutually beneficial relations with the business community and provide Ukrainian society with really high-quality, modern, innovative services. We believe that this mechanism will be a great opportunity for investors in Ukraine
